Waiver of Liability and Indemnity Agreement

Volunteer & Event Participant

This Waiver of Liability and Indemnity Agreement (“Agreement”) is made and entered into as of the date of signature below by and between the (“Volunteer”), and Help Us to Help Others, Inc., with its principal place of business at 649 Demere St, Hinesville Ga 3131(“Organization”).

WHEREAS, The Volunteer desires to volunteer his/her time and services to the Organization; andWHEREAS, The Organization welcomes the services of Volunteer; andWHEREAS, The Volunteer acknowledges that volunteering involves certain inherent risks and dangers;

NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows:

  1. Assumption of Risk: The volunteer understands and acknowledges that volunteering with the Organization involves certain inherent risks and dangers, including but not limited to:

    • Physical Risks: Risks of injury from accidents, falls, exposure to the elements, and contact with animals or other volunteers.

    • Emotional Risks: Risks of exposure to traumatic events, distressing situations, and emotional distress.

    • Travel Risks: Risks associated with travel to and from volunteer sites, including traffic accidents and other unforeseen events.

  2. Release of Liability: Volunteer hereby releases, waives, discharges, and covenants not to sue the Organization, its officers, directors, employees, agents, volunteers, and insurers from any liability, claims, demands, actions, causes of action, damages, losses, costs, expenses (including attorneys’ fees), and liabilities of any kind whatsoever, whether known or unknown, arising out of or in any way connected with Volunteer’s participation in volunteer activities with Organization, including but not limited to:

    • Any injury, illness, or death sustained by a Volunteer while volunteering with the Organization.

    • Any loss or damage to the Volunteer’s personal property while volunteering with the Organization.

    • Any claim or suit brought by any third party against Volunteer arising out of Volunteer’s participation in volunteer activities with the Organization.

  3. Indemnification: Volunteer agrees to indemnify, defend, and hold harmless the Organization, its officers, directors, employees, agents, volunteers, and insurers from and against any claims, demands, actions, causes of action, damages, losses, costs, expenses (including attorneys’ fees), and liabilities of any kind whatsoever, arising out of or in any way connected with Volunteer’s negligence or willful misconduct while volunteering with Organization.

  4. Insurance: The volunteer acknowledges that the Organization does not provide any insurance coverage for the Volunteer’s injuries or losses while volunteering. The volunteer is responsible for obtaining and maintaining any necessary insurance coverage.

  5. Binding Effect: This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and permitted assigns.  

  6. Governing Law: This Agreement shall be governed by and construed under the laws of the State of Georgia.

  7. Severability: If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.  

  8. Entire Agreement: This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.  

  9. Waiver of Jury Trial: Volunteer hereby waives any right to a jury trial in any action or proceeding arising out of or relating to this Agreement.

10. Acknowledgement and Agreement: The volunteer acknowledges that he/she has read this Agreement, understood its terms and conditions, and agreed to be bound thereby.

Help Us To Help Others, Inc Volunteer Agreement

As a volunteer for Help Us to Help Others, Inc., you play a crucial role in supporting our mission to assist veterans, first responders, and community volunteers during times of crisis. Your contributions directly impact the lives of those who serve our community and help ensure their well-being before, during, and after disaster strikes.

Key Responsibilities:

  • Fulfill assigned duties: This may include tasks such as event support, administrative assistance, community outreach, or direct service to beneficiaries.

  • Adhere to organizational policies and procedures: This includes maintaining confidentiality, following safety guidelines, and complying with all relevant regulations.

  • Communicate effectively: Maintain open and honest communication with staff and other volunteers.

  • Represent Help Us To Help Others, Inc. professionally: Conduct yourself in a manner that reflects positively on the organization.

  • Attend trainings and meetings as required: Participate in any required trainings or meetings to enhance your understanding of your role and the organization's mission.

Key Expectations:

  • Reliability and punctuality: Arrive on time for your assigned shifts and fulfill your commitments.

  • Flexibility and adaptability: Be willing to adapt to changing circumstances and assist with various tasks as needed.

  • A positive and supportive attitude: Maintain a positive and supportive attitude towards fellow volunteers, beneficiaries, and the organization.

  • Commitment to safety: Prioritize safety in all your activities and adhere to all safety guidelines.

  • Respect for diversity and inclusion: Treat all individuals with respect and dignity, regardless of their background or circumstances.

By fulfilling these responsibilities and expectations, you will be a valuable asset to Help Us To Help Others, Inc. and contribute to our mission of supporting those who serve our community.
